# Michigan Citizen Voting Integrity Act

## Purpose

The purpose of this Act is to preserve the integrity of elections within the State of Michigan by ensuring that only citizens of the United States who are lawfully eligible under state and federal law may register to vote or cast ballots in any local, state, or federal election conducted within the State of Michigan.

## Section 1. Definitions

For purposes of this Act:

1. “United States Citizen” means:
a. A person born within the United States or its lawful territories; or
b. A person lawfully naturalized under federal immigration law.

2. “Knowingly unlawful voting” means intentionally registering to vote or casting a ballot while knowingly lacking lawful eligibility under the Constitution and laws of the United States and the State of Michigan.

3. “Election official” means any employee, volunteer, clerk, or administrator involved in voter registration, ballot processing, or election administration.

## Section 2. Citizenship Verification Requirement

1. All persons registering to vote in the State of Michigan shall provide documentary proof of United States citizenship.

2. Acceptable documentation may include:
a. Birth certificate issued by a U.S. state or territory;
b. United States passport;
c. Certificate of naturalization;
d. Other federally recognized proof of citizenship approved by the Secretary of State.

3. The Michigan Secretary of State shall establish secure verification procedures to confirm citizenship status while protecting lawful voters from unnecessary burdens or delays.

## Section 3. Prohibition on Unlawful Voting

1. No person who is not a United States citizen shall:
a. Register to vote in the State of Michigan; or
b. Cast a ballot in any election conducted within the State of Michigan.

2. Any person found to have knowingly violated this section commits the offense of Election Fraud by Unlawful Voting.

## Section 4. Criminal Penalties

1. A person convicted of knowingly unlawful voting involving fraudulent documentation, identity theft, multiple ballots, or organized election fraud may be guilty of a felony punishable by:
a. Imprisonment for up to 25 years in severe or organized fraud cases;
b. Monetary fines determined by the court; and
c. Permanent prohibition from voting within the State of Michigan where constitutionally permitted.

2. Lesser offenses involving administrative or non-malicious violations shall be prosecuted proportionally under existing Michigan election law.

## Section 5. Referral to Federal Authorities

1. Any non-citizen convicted under this Act shall have their case referred to the appropriate federal immigration authorities for review under federal immigration law.

2. Nothing in this Act shall be interpreted as granting the State of Michigan independent deportation authority.

## Section 6. Election Integrity Oversight

1. The State of Michigan shall conduct regular audits of voter registration systems to identify duplicate registrations, fraudulent registrations, and unlawful voting activity.

2. Any election official found knowingly facilitating unlawful registration or unlawful voting shall be subject to criminal prosecution and immediate removal from office.

## Section 7. Constitutional Compliance

If any provision of this Act is found unconstitutional or unenforceable, the remaining portions shall remain in full force and effect.
