A BILL
to establish a lawful presence compliance framework for undocumented individuals residing in this state, to declare the supremacy of the Constitution of the United States as the singular governing law within this state, to provide a 120-day grace period for voluntary compliance and initiation of federal legal status processes, to create the Michigan Office of Immigration Compliance, to direct full state cooperation with federal immigration enforcement and to suspend conflicting sanctuary policies, to condition the receipt of state-funded benefits, and to protect lawful immigrants and naturalized citizens; and to prescribe the powers and duties of certain state agencies and officials; and to provide remedies and penalties.
The People of the State of Michigan enact:

Sec. 1. Short title. This act shall be known and may be cited as the "Michigan Citizens Protection Act".

Sec. 2. Legislative findings and intent. The legislature finds that:

Sec. 3. Definitions. As used in this act:

Sec. 4. Declaration of constitutional supremacy. The Constitution is the supreme and singular governing law of this state. A religious law, foreign cultural practice, ideological framework, or custom of any nation, faith, or group shall not be recognized, enforced, or permitted to operate in place of, or in conflict with, the Constitution or the laws of this state within the borders of this state. Any individual residing in this state, regardless of immigration status, is subject to and bound by the Constitution and the laws of this state without exception.

Sec. 5. Grace period for voluntary compliance; conditions; forfeiture. An undocumented individual currently residing in this state is granted a grace period during which the individual may voluntarily come forward and take one or more of the following lawful actions:

During the grace period, an undocumented individual who voluntarily registers with the office and demonstrates active compliance with this act shall not be referred by a state agency to federal immigration authorities solely on the basis of the individual's undocumented status. To obtain and maintain the protection provided by this section, an individual shall do all of the following:

An individual who commits a criminal offense, violates constitutional law, or engages in conduct incompatible with the laws of this state during the grace period immediately forfeits all protection under this act and shall be referred to federal immigration enforcement authorities without delay.

Sec. 6. Michigan Office of Immigration Compliance. The Michigan Office of Immigration Compliance is created as a standing office of this state and shall be established and operational not later than 15 days after the effective date of this act. The office shall:

Sec. 7. Denial of state benefits to non-compliant individuals. Upon expiration of the grace period, an undocumented individual who has not registered with the office and demonstrated active pursuit of legal status is ineligible for all state-funded benefits, programs, services, and assistance, including, but not limited to:

Sec. 8. Cooperation with federal immigration enforcement; sanctuary policies suspended. Every state agency, department, law enforcement entity, and public institution shall fully cooperate with all lawful requests from United States Immigration and Customs Enforcement, United States Customs and Border Protection, and any other federal immigration enforcement authority. A state agency, department, county, municipality, or public institution shall not adopt, maintain, or enforce a policy that shields or protects undocumented individuals from, or that prevents the identification of undocumented individuals to, federal immigration authorities. Any sanctuary city or sanctuary county policy in effect within this state is declared to be in conflict with this act and is suspended and unenforceable.

Sec. 9. Referral of non-compliant individuals to federal authorities. Upon expiration of the grace period, the office shall compile and transmit to federal immigration enforcement authorities the identities of all known undocumented individuals within this state who have failed to register and demonstrate compliance with this act. The authority to detain, process, and remove non-compliant individuals rests with federal immigration authorities, and this state shall provide full cooperation and assistance in that process.

Sec. 10. Constitutional conduct requirement. Every individual residing in this state, regardless of immigration status, shall conduct himself or herself in full accordance with the Constitution and the laws of this state. An individual, regardless of religion, culture, national origin, or ideology, who engages in conduct that violates constitutional law, who advocates for the replacement of constitutional law with religious or foreign legal frameworks, or who actively works to subvert the constitutional order of this state or nation shall be referred to the appropriate federal and state authorities for investigation and action under existing federal and state law.

Sec. 11. Protection of legal immigrants and naturalized citizens. This act shall not be construed to apply to United States citizens, lawful permanent residents, visa holders, asylum seekers with pending federal cases, recipients of active federal deferred action status, or any individual with a recognized legal immigration status under federal law. Legal immigrants and naturalized citizens are valued members of this state, and this act affirms and honors their commitment to following the law. This act is directed solely at individuals who are present in this state without any lawful immigration status and who have made no effort to obtain one.

Sec. 12. Penalties. A person or entity that violates this act by knowingly shielding an undocumented individual from federal immigration enforcement in contravention of section 8, or that otherwise knowingly acts to defeat the purposes of this act, is subject to a civil fine of not more than $50,000.00 for each violation, in addition to any other remedy available under law.

Sec. 13. Effective date. This act takes effect 90 days after the date it is enacted into law.
